The Eaton product cross-reference information available via this tool (the “Cross-Reference Information”) is proprietary and provided to any party receiving Cross-Reference Information (a “Receiving Party”) on a CONFIDENTIAL and “AS IS” basis. In making this tool, and access to the Cross-Reference Information obtained via its use, available, Eaton SPECIFICALLY DISCLAIMS ANY EXPRESS OR IMPLIED WARRANTIES OF ANY TYPE, INCLUDING, BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR ANY PARTICULAR PURPOSE. While Eaton has undertaken commercially reasonable efforts to identity which Eaton products would be considered functionally equivalent to other companies’ products, these Eaton products identified may not necessarily be equivalent as to all form-fit-function or other requirements, features, or specifications. Eaton shall not be liable or responsible for any claims based upon the receipt and/or use of the Cross-Reference Information by the Receiving Party or any of its customers, or for any incidental or consequential harm arising therefrom. In particular, the Receiving Party agrees to advise all users of its own and/or Eaton’s product cross-reference business tools of the important need to independently verify and ensure for itself that any Eaton product identified through such tools is an appropriate replacement for another company’s product in a particular application.
